1. Acceptance of Terms
By accessing or using Tradee Hub ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. These terms apply to all users, including companies and individual contractors.
2. What Tradee Hub Is — and Is Not
Tradee Hub is a technology platform that provides tools to help companies and self-employed tradespeople find and connect with each other. That is the full extent of our role.
Tradee Hub is not a recruitment agency, employment agency, labour hire provider, or party to any agreement made between users on the Platform. We do not employ, endorse, recommend, verify, or vouch for any contractor or company listed on the Platform.
Any information displayed on a user's profile — including qualifications, certifications, experience, and credentials — is self-reported by that user. Tradee Hub does not independently verify this information. You are solely responsible for conducting your own due diligence before entering into any agreement.
3. Payments — Not Our Responsibility
Tradee Hub does not process, hold, transfer, or facilitate payments between companies and contractors. Any payment arrangements agreed between users are entirely between those parties.
We accept no responsibility or liability for:
- Non-payment or late payment between a company and contractor
- Disputes over agreed rates, hours worked, or invoices
- Withholding of wages or entitlements
- Payment fraud or unauthorised transactions between users
- Tax obligations arising from any work arrangement
The subscription fees you pay to Tradee Hub are solely for access to the Platform and are separate from any payment arrangements between users.
4. Recommendations and Decisions — Your Responsibility
Tradee Hub does not recommend, rank, or endorse any contractor or company. The Platform provides tools for you to review profiles, reputation scores, and other information so that you can make your own informed decision.
We accept no responsibility or liability for:
- The quality, safety, or standard of any work performed
- The suitability of any contractor for any particular job
- Any injury, loss, or damage arising from work arranged through the Platform
- The accuracy of profile information, credentials, or reputation scores
- Any failure by a contractor to hold required licences or insurance
- Any employment relationship or contractor classification dispute
You must satisfy yourself, through your own enquiries, that any person you engage is suitable, qualified, insured, and legally entitled to perform the work.
5. Limitation of Liability
To the maximum extent permitted by New Zealand law, Tradee Hub Limited and its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Platform, including but not limited to:
- Loss of income, profits, or business opportunities
- Loss arising from reliance on any profile information
- Loss arising from any transaction or agreement between users
- Platform downtime, errors, or data loss
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, to the extent such limitation is not permitted under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
6. User Obligations
By using the Platform, you agree to:
- Provide accurate, truthful information on your profile
- Keep your account credentials secure and confidential
- Not impersonate another person or business
- Not use the Platform for any unlawful purpose
- Not post false reviews, ratings, or misleading information
- Comply with all applicable New Zealand laws, including employment law and health and safety obligations
We reserve the right to suspend or terminate accounts that breach these obligations without notice or refund.
7. Subscriptions and Fees
Subscription fees are charged in advance and are non-refundable except where required by the Consumer Guarantees Act 1993. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and you retain access until then.
We reserve the right to change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
8. Platform Availability
The Platform is provided "as is" and "as available". We do not guarantee uninterrupted, error-free access. We may perform maintenance, updates, or changes to the Platform at any time without notice. We are not liable for any loss caused by Platform downtime or unavailability.
9. Governing Law
These Terms of Service are governed by the laws of New Zealand. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the New Zealand courts.
10. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you by updating the "Last updated" date at the top of this page. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms.
